Background

On its website, Trafikverket.se, the Swedish Transport Administration provides data products that give you access to static and dynamic road and rail data.

These licensing terms and conditions (“the Contract”) describe the conditions under which the data products are provided, as well as what you are entitled to do and obliged to do when you use the data products.

By giving your approval to this Contract, you certify that you have read, understood and approved the conditions specified herein, as well as the documents referred to in the Contract.

1. Licence

The Swedish Transport Administration hereby grants you a non-exclusive, non-transferable and revocable licence to use the data products in accordance with this Contract. This licence, and the products and services that you develop under it, shall not imply any limitation of the right of the Swedish Transport Administration’s and our data sources freely to use, develop, alter and stop providing the data products, their content, and associated products and services.

As described below, we will nevertheless keep you updated about alterations regarding the data products and about our ability to provide them.

2. Intellectual property rights

2.1 The Swedish Transport Administration and/or the third parties with which we collaborate are the holders of the intellectual property rights to data products. Unless you have received our specific approval in writing that you may do so, you are not entitled to claim intellectual property rights for, publish, copy, transfer, license, or in any other way relevant to intellectual property law make use of the data products’ source code or call structure.

You are not entitled to refer to the Swedish Transport Administration’s trade name or trademarks in connection with using the data product content in products or services developed by you.

2.2 By connecting to the data products, you grant the Swedish Transport Administration a non-exclusive, non-transferable and non-sublicensable licence to refer to your trade name and any products and services in which you use the data product content (including any trademarks that you have for such products or services), for the purpose of providing the information that you use the data products. The Swedish Transport Administration’s right to use your trade name and trademarks is limited to source references made for this purpose.

3. Processing of personal data

3.1 When choosing to connect to the data products, you may need to register certain personal data attributable to you. By registering your personal data, you consent to the Swedish Transport Administration processing this data for purposes of administering, monitoring and enabling your use of the data products, and to the Swedish Transport Administration, as the controller of personal data under the Personal Data Act (1998:204), processing your personal data in accordance with our Policy for processing of personal data.

4. Technological requirements and limitations

4.1 You may only connect to the data products in the way described in our instructions, and you may not use technological means to gain unauthorised access to, disrupt or deactivate the data products. This entails, but is not limited to, your undertaking not to spread viruses, worms, Trojans or other malicious code in the data products or on the website where the data products are provided.

5. Other requirements for your use

5.1 If you are a private individual you must be at least 18 years of age to have the right to enter into this Contract and to be given access to the data products.

5.2 You are not entitled to use the data products or their content for products or services that could damage the Swedish Transport Administration’s operations or conflict with our interests.

5.3 You are not entitled to use the data products or their content for products or services that infringe, or that encourage the infringement of, applicable laws and ordinances.

5.4 If you have any questions about the implications of the limitations described under Item 5, “Other requirements for your use”, or would like to use the data products or their content in some other way than it describes, contact us through the form under "Show contact details".

6. Liability

6.1 We strive to improve the data products continuously, and would welcome information from you regarding any errors or deficiencies in the user experience. Please email any such information to trafikinforjtjänster, see information under Show contact details. As specified below, however, our ability to rectify errors or problems is limited.

You are aware of and accept the circumstance that the Swedish Transport Administration does not provide any pledge or guarantee regarding the quality, security, reliability, accessibility or performance of the data products or their content. Regardless of what is stated in our Technical Documentation, Alteration policy or in any descriptions of a data product’s function provided together with it, you can therefore not expect the data products to be free of errors or security problems, be updated, or be a suitable data source for the products or services you intend to use them in.

6.2 You are aware of and accept the circumstance that you use the data products at your own risk, and that the Swedish Transport Administration will not be held liable for any direct or indirect damage inflicted on you as a result of your using, or being unable to use, the data products or their content. For the purposes of this Contract, “indirect damage” means e.g. unrealised profit, unrealised use of your products or services, compensation for use of a replacement service, data loss, costs for debugging, damage to goodwill and damage due to viruses and other security-related problems.

6.3 You promise to indemnify the Swedish Transport Administration, our partners and employees from any claims from third parties arising from any use by you of the data products or their content in contravention of this Contract.

7. Alterations

7.1 We reserve the right to update and alter data products, data products’ content and this Contract, all in accordance with our Alteration policy. The Alteration policy specifies what alterations may occur, how you will be informed of them and what advance notice you will receive of them.

7.2 Alterations to this Contract will be documented by means of publication by us of a new version of the terms and conditions. Each new version of the terms and conditions will have a new version number at the end the document.

7.3 By continuing to use the data products after an alteration has been implemented, you confirm that you accept the alteration. If you are unwilling to accept an alteration, you will no longer have the right to use the data products and will have to interrupt your connection to the data products as specified in Item 8 below, “Term of contract and Termination”.

8. Term of contract and Termination

8.1 This Contract, and your licence to use the data products, enters into force when you give the Contract your approval, and remains in force for as long as the Swedish Transport Administration continues to provide the data products, unless it is terminated prematurely in accordance with the item “Term of contract and Termination”.

8.2 The Swedish Transport Administration reserves the right to give notice of immediate termination of this Contract, and to terminate your connection to the data products, if you use data products or their content in contravention of what is stipulated herein. We also reserve the right to stop providing, temporarily or definitively, and following our own fair assessment and notice of this to you in accordance with our Alteration policy, all or some of the data products and their content.

You have the right to terminate this Contract at any time, without specific reason and at no cost. Such termination is effected by discontinuing your connection to the data products and sending an email to datex through the form under "Show contact details" specifying your user information and that you wish to terminate the Contract.

9. Miscellaneous

9.1 This Contract constitutes the complete regulation of all issues regarding your right to use the data products and their content. Alterations or additions to this Contract, other than new versions of it, shall be carried out in accordance with the item “Alterations” above.

9.2 You are not entitled to transfer your rights and obligations under this Contract to a third party. The Swedish Transport Administration reserves the right, following dispatch of special notice to you, to transfer the Contract to a company with our group or to a third party acquiring all or parts of our operations.

9.3 This Contract shall be governed by Swedish law. Any dispute arising as a result of this Contract shall be settled by the Swedish courts.
